Privacy policy
What I collect and why
| What | When | Why (legal basis) | How long |
|---|---|---|---|
| Your drawing, the name you type (unless you choose “Stay anonymous”) and your short message | You press “Send to Fab” on the drawing board | To show it on the public Art Wall and in my gallery — your consent (GDPR Art. 6(1)(a)), given by pressing “Send to Fab” after the notice that the drawing goes on the public wall | Until you ask me to remove it, or I remove it |
| Name, e-mail, phone (optional), project details and any files you attach | You send a brief (“Start a brief”) | To read your enquiry, reply and prepare an offer — steps before a contract at your request (Art. 6(1)(b)) | Up to 12 months after our last contact, longer only if we start working together (then as long as the law requires for business records) |
| E-mails you send me | You write to me | To answer you (Art. 6(1)(b) or my legitimate interest in replying, Art. 6(1)(f)) | As long as needed for the conversation, max. 3 years |
| Technical data: IP address (only as a one-way hash), time of request | Every send, password or sign-in attempt | Security and spam protection — my legitimate interest (Art. 6(1)(f)) | Short-lived counters that expire automatically: 10 minutes for briefs, 30 minutes for password attempts, 1 hour for drawings |
The site’s code contains no analytics, advertising or tracking tools, and I don’t sell or rent anyone’s data. Cloudflare, which hosts the site, processes technical request data (such as IP addresses) to deliver and protect it.
Who else touches the data
- Cloudflare, Inc. — hosting, database and file storage for the site, and the Turnstile bot check (data processor). Cloudflare also uses Turnstile signals on its own behalf to improve bot detection — see the Turnstile Privacy Addendum.
- My e-mail provider — when I reply to you.
Some of these providers may process data outside the European Economic Area; they do so under the European Commission’s standard contractual clauses or the EU–US Data Privacy Framework.
Your rights
You can ask me to access, correct, delete or export your data, to restrict or object to processing, and you can withdraw consent at any time (for the Art Wall: just e-mail me and I’ll take the drawing down — this doesn’t affect what was lawful before). Write to hi@byfabc.com. You can also complain to the Polish supervisory authority, the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warszawa.
Giving data is voluntary. Without a name or e-mail I simply can’t reply to a brief. The Art Wall works anonymously if you want.
Drawing wall terms
1. What you confirm when you press “Send to Fab”
- You drew it yourself, or you have the right to share it.
- It doesn’t break the law or anyone’s rights, and it doesn’t show other people’s personal data (no phone numbers, addresses or faces of people who didn’t agree).
- You are at least 16 years old, or a parent or guardian agreed.
2. Rights to the drawing
- Public dedication. To the fullest extent the law allows, you dedicate the drawing and your message to the public under CC0 1.0 — anyone, including FABC, may copy, change, publish and use it, also commercially, without asking you or paying you.
- Licence to FABC. Where a full waiver isn’t possible, you grant FABC (Fabian Cieniuch) a free, worldwide, non-exclusive, irrevocable, unlimited-in-time licence, with the right to sublicense, to use the drawing in every field of use — in particular recording and copying it by any technique, putting it online and on the Art Wall, in print, merchandise, exhibitions, social media, advertising, and making and using changed versions (derivative works).
- Credit. You agree not to exercise your moral right to be named or to object to changes, as far as the law allows. If you used “Stay anonymous”, your name is never shown.
- Under Polish copyright law an outright transfer of author’s economic rights needs a signed written agreement. If you’d like to transfer your rights to FABC exclusively, e-mail me and we’ll sign one.
3. Moderation
I may decline, hide or delete any drawing, for any reason and without notice. If you want your drawing taken down, write to hi@byfabc.com — I’ll remove it from the Art Wall, though copies other people already made under CC0 can’t be recalled.
Briefs & confidentiality
- Everything you send in a brief — text, files, contact details — is treated as confidential. It’s never published, never shown in my portfolio and never shared with anyone else without your written permission.
- I use it only to understand your project, reply and prepare an offer.
- I’ll reply from hi@byfabc.com or from my own e-mail address (Fabian Cieniuch).
- Ideas and materials in your brief stay yours. Sending a brief doesn’t create a contract; any work, fees and rights to the results are agreed separately in writing.
- If we don’t start working together, I delete the brief and files within 12 months, or earlier if you ask.
Using this site
- All site content (design, film, images, texts, typefaces) is © Fabian Cieniuch / FABC unless stated otherwise.
- Please don’t try to break, overload or scrape the site, or upload anything harmful.
- The site is provided as it is; I do my best to keep it working, but can’t promise it’s always available.
- Polish law applies. Consumers keep all the rights their local law gives them.
- I may update this page; the date at the top shows the latest version.
